Drinking and Driving
An individual who operates a motor vehicle under the influence of alcohol or impaired by drugs can face life altering consequences. If you or a loved one have been arrested and charged with Driving While Intoxicated you need to contact Richard B. Stafford immediately. Cases involving the DWI Statute will impact not only your freedom but could also affect your ability to legally drive a motor vehicle. These cases can be divided into two categories which is determined by whether or not you take or refuse a chemical test.

If you consent to take a chemical test your blood alcohol level will determine what your charge. An individual who operates a motor vehicle with a blood alcohol level of .06 to .07 will be charged with Driving While Impaired. An individual who operates a motor vehicle with a blood alcohol level above .08 will be charged with Driving While Intoxicated. A driver can be charged with Aggravated Driving While Intoxicated when they are arrested and charged with driving while intoxicated and have a Blood Alcohol Content of .18 or higher. A conviction of Aggravated DWI carries enhanced penalties that include a mandatory jail sentence.

New York recently passed a law called "Leandra's Law". This means a driver of a motor vehicle can now be charged with a felony when they are arrested and charged with driving while intoxicated and have a child under the age of sixteen in their motor vehicle. This law does not require a prior conviction of an alcohol or drug related offense.

An Ignition Interlock System is required for anyone convicted of a misdemeanor or felony Driving While Intoxicated or Driving Under the Influence including first time offenders. An Ignition Interlock is a device that is installed in ones motor vehicle that requires a driver to blow into a breath testing machine to not only start their motor vehicle but to continuously blow into the machine every few minutes to keep the vehicle running. The Ignition Interlock must be installed in any car owned or driven by an individual who was convicted of Driving While Intoxicated or Driving Under the Influence at that individuals cost.
